Anti-circumvention of Safeguard measures applying for steel wire rod and steel coin imported into Vietnam (tax rate of 10.9% )

On July 26, 2018, the Ministry of Industry and Trade issued Decision No. 2622 / QD-BCT on conducting investigation for safeguard measures for steel wire rod and steel coin imported into Vietnam

On May 13, 2019, the Ministry of Industry and Trade issued  Decision No. 1230 on the application of anti-circumvention of safeguard measures for steel wire rod and steel coil imported into Vietnam.

Goods subject to anti-circumvention of  safeguard measures are the imported steel coil and wire products with HS codes: 7213.91.90, 7217.10.10, 7217.10.29, 7229.90.99, 9839.10.00.

Safeguard measures are applied in the form of additional import duties with a tax rate of 10.9% from May 28, 2019 to March 21, 2020 (if initial safeguard is not renewed).

Organizations and individuals that import the above-mentioned steel goods if they believe that their imported goods are different from domestically manufactured goods may submit a dossier of application for exemption of Safeguard measures.

Procedures for exemption from applying Safeguard measures are provided in Appendix 2 of the Notice attached to Decision 1230 / QD-BCT.

Note:

Wire rod and steel products with one of the following characteristics are excluded from the scope of application of anti-circumvention measures:

(i) Steel containing one of the elements with a percentage (%) by weight of the following range: Carbon (C)> 0.37%; Silica (Si)> 0.60%; Chromium (Cr)> 0.60%; Nickel (Ni)> 0.60%; Copper (Cu)> 0.60%.

(ii) Steel containing at the same time the elements with percent (%) content by weight in the following scope: Manganese (Mn) from 0.70% to 1.15%; Sulfur (S) is from 0.24% to 0.35%.

(iii) Steel with circular cross-section of 14mm or more.

(iv) Steel products are not yet produced in the country.

For organizations and individuals that import steel products under (i), section (ii), and (iii): to be excluded from the application of anti-circumvention measures, when importing goods It is necessary to submit to the Customs Branch where the procedures for documents are carried out to prove that the imported goods satisfy the criteria to be excluded and apply anti-circumvention measures as above.

For organizations and individuals that import steel products under section (iv): to be excluded from application of anti-circumvention measures, when importing goods, they must submit Decision on exemption of safeguard measures to the Customs Sub-Departments where they carry out procedures. Decision on exemption of safeguard measures issued by the Ministry of Industry and Trade. Procedures for exemption are implemented in accordance with Decree 10/2018 / ND-CP and Circular 06/2018 / TT-BCT.
