New regulations on establishment of foreign-invested vocational schools

Decree No. 15/2019/ND-CP dated February 1st, 2019 of the Government on providing guidelines for some articles and implementation of the Law on Vocational Education

This Decree provides for requirements and procedures for establishment of foreign-invested vocational schools and branch campuses of foreign-invested intermediate schools and colleges, foreign-invested vocational training center; requirements and procedures for issuance of the Certificate of registration of International Joint Training Program and requirements for establishment representative offices of foreign-invested vocational schools in Vietnam.

According to the new regulations at Article 9 of this Decree, a foreign-invested vocational school must have capital as follows: At least 05 billion VND for a vocational training center; At least 50 billion VND for an intermediate school; At least 100 billion VND for a college.

According to the earlier regulations at Article 16 of Decree No. 48/2015/ND-CP , the requirements pertaining to minimum investment capital were as follows: at least VND 60 million/student for a foreign-invested vocational training center; at least VND 100 million/student for foreign-invested vocational training schools or vocational college

With regard to branch campuses of foreign-invested intermediate schools and colleges, it is required to ensure that the investment amount achieves at least 25% of the aforesaid investment amounts

The validity period of the operation license granted to the representative office of a foreign vocational school in Vietnam shall not exceed 05 years. If such period is extended, it shall not exceed 03 years.

To amend point i Clause 5 Article 47 of Decree No. 29/2012/ND-CP dated April 12th, 2012. To replace some phrases regulated in Decree No. 11/2015/ND-CP dated January 31st, 2015; To amend, supplement to a number of articles of Decree No. 79/2015/ND-CP dated September 14th, 2015;

To amend Clause 1 Article 17 of Decree No. 86/2015/ND-CP dated October 2nd, 2015; To amend Clause 1 Article 14 of Decree No. 113/2015/ND-CP dated November 9th, 2015; To amend Article 14 of Decree No. 143/2016/ND-CP dated October 14th, 2016; To replace form No. 3 at the Annex issued together with Decree No. 49/2018/ND-CP dated March 30th, 2015;

To abolish the phrase “the Ministry of Training and Education” regulated in Clause 1 Article 7 of Decision No. 53/2015/QD-TTg dated October 20th, 2015.

This Decree takes effect from March 20th, 2019 and replaces Decree No. 48/2015/ND-CP dated May 15th, 2015.
