On 22 April 2019, Ministry of Finance issued letter no. 4693/BTC-TCHQ on Customs value for exported goods to reply question of Vietnam Minerals and Metallurgy Company Limited. The content is as below:
In order to determine customs value for exported goods at the proposal of the Company, the Ministry of Finance has the following opinions;
– Pursuant to Clause 2, Article 86 of the Customs Law No. 54/2014 / QH13,The Customs value is the selling price of goods at exporting checkpoint exclusive of international insurance cost , international freight cost .
– Pursuant to Clause 1, Article 20 of Decree No. 08/2015 / ND-CP dated January 21, 2015, Clause 8, Article 1 of Decree No. 59/2018 / ND-CP dated April 20, 2018 of the Government, The Customs value is the selling price of goods at exporting checkpoint exclusive of international insurance cost , international freight cost .
– Pursuant to Article 4 of Circular No. 39/2015 / TT-BTC dated March 25, 2015, Clause 15 of Article 1 of Circular No. 39/2018 / TT-BTC dated April 20, 2018 of the Ministry of Finance, The Customs value is the selling price of goods at exporting checkpoint exclusive of international insurance cost (I), international freight cost (F) .
Selling price of goods calculated to exporting checkpoint are determined on the basis of sale price stated in goods sale and purchase contract or forms of legal value equivalent to goods sale and purchase contracts, commercial invoices and relevant documents that suitable for real exported goods.
This Official Letter replaces the contents of customs valuation for exported goods in the Finance Ministry’s Official Dispatch No. 15634 / BTC-CST dated November 2, 2016, sent to the Lao Cai National Assembly Delegation. Official Letter No. 16486 / BTC-CST dated 06/12/2017 of the Ministry of Finance; Official Letter No. 4052 / TCHQ-TXNK dated July 10, 2018 and Section 1 of Notice No. 5898 / TB-TCHQ dated 09/10/2018 of the General Department of Customs.
