List of Restricted Sectors for foreign investors In Vietnam (New Law on Investment 2020)

Under the New Law on Investment 2020 ( Decree No. 31/2021 / ND-CP) , All sectors with market access restrictions for foreign investors will be aggregated into an official list issued by the Government (“List of restricted sectors”). . The list of restricted sectors will be divided into two groups: (i) a group of sectors not open to foreign investors and (ii) another group of sectors where market access is required foreign investors with conditions.
Foreign investors wishing to invest in sectors outside of these restricted sectors will be treated as Vietnamese investors.

Group of sectors which are not opened to foreign investors in Vietnam:

  1. Trading in goods and services on the list of goods and services exercised exclusively by the State in the field of commerce.
  2. Press activities and information gathering in any form.
  3. Catching or exploiting seafood.
  4. Investigation and security services.
  5. Administrative and judicial services, including judicial assessment service, redundancy service, property auction service, notary service, administrator service.
  6. Services of sending workers to work abroad under contracts.
  7. Investment in the construction of infrastructure of cemeteries and graveyards to transfer land use rights associated with the infrastructure.
  8. Garbage collection services directly from households.
  9. Public opinion polling service (public opinion polling).
  10. Blasting service.
  11. Manufacturing and trading weapons, explosives and supporting tools.
  12. Importing and dismantling used ships.
  13. Public postal services.
  14. Goods transfer business.
  15. Trading in temporary import for re-export.
  16. Exercise of the right to export, import, and distribution for goods on the list of goods, foreign investors, foreign-invested economic organizations are not allowed to exercise the right to export or to import, distribution rights.
  17. Collection, purchase and handling of public property in units of the armed forces.
  18. Manufacture of military materials or equipment; dealing in military equipment, military for the armed forces, military weapons, equipment, techniques, weapons, military and police specialized means, components, parts, spare parts, supplies and special equipment and technologies for their manufacture;
  19. Providing industrial property representation services and intellectual property assessment services.
  20. Services of setting up, operating, maintaining and maintaining navigation aids, water zones, water areas, public navigational channels and maritime routes; service of surveying water zones, water areas, public navigational channels and maritime routes serving the announcement of maritime notices; Services of surveying, constructing and publishing nautical charts for water bodies, seaports, navigational channels and maritime routes; building and publishing marine safety documents and publications.
  21. Navigation services to ensure maritime safety in water zones, water areas and public navigational channels; marine electronic information service.
  22. Inspection (inspection, testing) and certification services for means of transport (including systems, components, equipment and components of vehicles); inspection and issuance of certificates of technical safety and environmental protection for vehicles, specialized equipment, containers, and dangerous goods packaging equipment used in transportation; inspection and issuance of certificates of technical safety and environmental protection for oil and gas exploration, exploitation and transportation means and equipment at sea; technical inspection service of occupational safety for machines and equipment with strict requirements on occupational safety installed on means of transport and means, exploration and exploitation equipment and oil and gas transportation at sea; fishing vessel registry service.
  23. Services of investigation, assessment and exploitation of natural forests (including logging and hunting, trapping of rare and precious wild animals, management of the fund for plant genes, livestock and microorganisms used in Agriculture).
  24. Research or use genetic resources of new livestock breeds before being appraised and evaluated by the Ministry of Agriculture and Rural Development.
  25. Business travel services, except international travel services for international tourists to Vietnam.

Group of sectors in which the market access of foreign investors are subject to conditions  in Vietnam

  1. Production and distribution of cultural products, including video recordings.
  2. Production, distribution and projection of television programs and works of music, theater, and cinema.
  3. Providing radio and television services.
  4. Insurance; Bank; securities trading and other services related to insurance, banking, and securities trading.
  5. Post and telecommunications services.
  6. Advertising service.
  7. Printing service, publishing service.
  8. Measurement and mapping services.
  9. Photography service from above.
  10. Educational Services.
  11. Exploration, exploitation and processing of natural resources, minerals, oil and gas.
  12. Hydropower, offshore wind power and nuclear energy.
  13. Transport of goods and passengers by rail, air, road, river, sea, pipeline.
  14. Raising and growing aquatic products.
  15. Forestry and hunting.
  16. Business betting, casino.
  17. Security Services.
  18. Construction, operation and management of river ports, seaports and airports.
  19. Real estate business.
  20. Legal services.
  21. Veterinary services.
  22. Goods sale and purchase activities and activities directly related to goods sale and purchase activities by foreign service suppliers in Vietnam.

  44. Cultivation, production or processing of rare crops, breeding of rare wildlife and the processing and handling of these animals or plants, including live animals and preparations products from them;
  45. Production of building materials.

  47. Motorcycle assembly.
  48. Services related to sports, fine arts, performing arts, fashion shows, beauty and model competitions, and other recreational activities.
  49. Air transport support services; ground technical services at airports and airports; catering services on the aircraft; navigation information services, aviation meteorological services.
  50. Ship agency services; ship towing services.
  51. Services related to cultural heritage, copyright and related rights, photography, video recording, recording, art exhibitions, festivals, libraries, museums;
  52. Services related to promotion and promotion of tourism.
