Regulations of rules of origin of goods in EVFTA


The Ministry of Industry and Trade issued Circular 11/2020 / TT-BCT regulating the rules of origin of goods in the Free Trade Agreement between Vietnam and the European Union (EVFTA).

Accordingly, the general provisions on the mechanism of certification of goods origin are as follows:

  • Goods of European Union origin imported into Vietnam are eligible for preferential tariffs under EVFTA when submitting one of the following certificates of origin:
  • C / O is issued under the provisions of Article 20 to Article 23 of Circular 11/2020.
  • A document of self-certification of origin as prescribed in Article 24 of Circular 11/2020 issued by a qualified exporter in accordance with the provisions of the European Union for shipments of any value; or any exporter issuing a shipment not exceeding EUR 6,000 (six thousand euros).
  • The self-certification document issued by the exporter is registered in the electronic database in accordance with European Union regulations and has been notified to Vietnam. The notice may include a provision that the European Union ceases to apply Points a and b, Clause 1, Article 19 of Circular 11/2020.
  • Goods of Vietnamese origin imported into the European Union are eligible for preferential tariffs under EVFTA when they have one of the following certificates of origin:
  • C / O is issued in accordance with Article 4 and from Article 20 to Article 23 of Circular 11/2020.
  • Self-certification of origin as prescribed in Article 25 of Circular 11/2020 issued by the exporter whose shipment is not more than 6,000 EUR (six thousand euros).
  • A self-certification document issued by a qualified exporter or exporter registered in a database in accordance with the regulations of the Ministry of Industry and Trade.
  • The self-certification of origin of goods specified at Point c, Clause 2, Article 19 of Circular 19/2020 shall comply with the regulations of the Ministry of Industry and Trade and apply after Vietnam notifies the European Union.
  • In the case of Article 29 of Circular 11/2020, goods of origin are eligible for EVFTA without having to submit documents certifying the origin of goods as prescribed in Article 19 of Circular 11/2020.

Circular 11/2020 / TT-BCT officially takes effect from August 1, 2020.
